A court order is only as effective as its enforcement. If the other party is refusing to pay court-ordered child support, denying your possession time with your children, or failing to comply with the terms of a divorce decree or family court order, you have legal recourse. The Law Office of Ryan Putz represents clients in enforcement actions in Walker County's District Court, holding non-compliant parties accountable under Texas law.

Texas Family Code Chapter 157 governs the enforcement of child support obligations. If the obligor parent has failed to pay court-ordered child support, the following enforcement tools are available:

  • Contempt of Court: The court can hold a non-paying parent in contempt, which may result in fines, suspension of licenses, or confinement in jail.

  • Wage Withholding: Texas law requires income withholding orders in virtually all child support cases. If an employer is not complying or the obligor has changed jobs, we can obtain and serve updated withholding orders.

  • License Suspension: Texas may suspend a delinquent obligor's driver's license, professional license, or recreational license until arrears are paid or a payment plan is established.

  • Seizure of Assets: The court may order the seizure of bank accounts, tax refunds, lottery winnings, or other assets to satisfy child support arrears.

  • Credit Reporting: Child support arrears may be reported to consumer reporting agencies, affecting the obligor's credit.

We can help you pursue back child support (arrears) and ensure that enforcement mechanisms are in place to prevent future non-payment.

If the other parent is withholding your court-ordered possession time — refusing to turn the child over, relocating the child without authorization, or otherwise interfering with your parenting time — you can bring an enforcement action under TFC Chapter 157. Remedies include:

  • Contempt findings with fines or confinement

  • Make-up possession time to compensate for denied visits

  • Attorney's fees and court costs awarded against the violating party

  • Modification of the custody arrangement if the pattern of interference is severe

Enforcement of Divorce Decree Property Division

If your former spouse has failed to transfer property, pay a debt, or comply with other property division terms in your divorce decree, Texas Family Code §§ 9.001–9.014 provide enforcement mechanisms. We can file a motion to enforce the property division or seek a clarifying order that gives specific direction for compliance, and pursue contempt if the non-compliance continues.

Failure to pay court-ordered spousal maintenance can be enforced through contempt proceedings in the same manner as child support. If you are not receiving the maintenance payments the court ordered, we can file an enforcement action and recover arrears.
